for context: in 2016 (the last year for which data is available), DOJ pursued ~180,000 criminal cases around the country. we have documentation of a grand jury nixing a prosecution in SIX of those cases. of the cases that DOJ chose not to prosecute, grand juries refusing to indict account for 0.02%
