The US government arguing that it doesn’t have have territorial jurisdiction under the 14th amendment (and therefore cannot grant birthright citizenship) is easily the weakest constitutional argument I’ve read in the last 20 years.

Arguing that all people within the territories of the United States are not subject to the jurisdiction thereof, is by functional legal application an admission that US jurisdiction is not territorial.
