Yes, as it's not made by a human. BUT fraudulently saying you made it is misrepresenting (Saying something was made in one country but it was made elsewhere is close), and a convention can prevent someone from offering it.

Yes, unless it is further modified by a human. The copyright board in the US allowed a comic book with AI slop images to be copyrighted because the story was written by a human, or something like that.
