That's a separate question from which branch of government (and at what level, state vs. Federal) gets to exercise those powers. I read Art. I as quite clearly giving most of them to Congress, not executive edict or military command.

There was evidence in the CA challenge that they have in fact been detaining people (and claim it's not an "arrest" even though the person isn't free to leave).

Their purpose is apparently to be seen, to instill fear and submission (and let the C-in-C see them on his teevee).

The entire operation, as in LA, is all about cosplaying very visibly, getting on TV, instilling fear, but not actually doing anything about any actual issues.

This is the core of the case: the WH position is apparently that the President's inherent Article II power as Commander in Chief overrides statutory limitations, including the Posse Commitatus Act.
If that prevails, there are no more rules, only the whims of one man.
