I think it’s a matter of degree. I don’t mind a paragraph opener before the question, especially because the QP is the first item the reader sees. I don’t even mind two paragraphs. But when the QP can’t be explained in less than two pages, it sort of screams “fact-laden.”

The Court has definitely granted cases with QPs more than a page. But as you've mentioned, long QPs are disfavored under the rules and signal weakness and lack of confidence.

You see the real crime is that nervous feeling I get around brown people.
One of the things I like about academia is that sometimes the academic arguments are way more sophisticated than arguments of non-academics.
