As anyone with jury duty experience knows, those who are called for service and actually want to be on a jury have a well above average chance of being picked. Liberal efforts to promote jury service as an activist duty, especially with federal juries, would be worth pursuing.

And regarding fairness I think it’s safe to say that you have to look to the fairness of society at large (ie do we want trans people to be accepted and feel safe) than at an individual sporting event. Because the bigots won’t stop at some point where you might find their position reasonable.

I mean, fairness is one thing, but this is not a question that can be answered by science. Beyond that, the least we should expect of any Dem politician is to not get baited into manufactured right wing “wedge” issues.

The main complaints about him on the left are his positions regarding trans persons and the homeless. I’m happy to have anyone taking the fight to the other side, but at the same time I understand people who refuse to support someone for higher office who will abandon the most vulnerable.
