The weaponisation of that to change the default and threshold of distress affecting a majority of social and public interactions (shopping, bathroom stalls, sport) is just deeply corrosive.

That rationale was always allowed and functioning (!) - delegating authority and legal cover to (say) someone running a women's shelter for an ad hoc solution to protecting cis and trans ppl in their care, where high distress around presentation might match a proportionate adjustment to service.

The thin core of sense in this ruling is attempting to match minimizing 'alarm or distress' with a proportionate service exclusion.
The bathroom obsession is the antithesis of that. It's mostly manufactured alarm (for all gender non-conforming, not trans), plus massive disproportionary exclusion

But there is no need to wait for the worst case scenario, because the worst case scenario is already here. Destruction of 70% of homes, and almost all infrastructure. 2m people displaced. People dying of starvation every day. About 100 people killed every day, as they look for food.

The Israeli cabinet ordered the expulsion of Gaza City residents by the 7th October 25. The IDF will then occupy the city.
If this goes ahead in the manner of IDF operations in Rafah, it would entail the physical destruction of Gaza City - one of the oldest cities in the Middle East.
