Every institution runs on legitimacy and nothing is stopping a sufficiently motivated President and Congress from completely changing the composition of the court. They've benefitted from a weak, reluctant opposition, but their popularity is rapidly waning.

Are you talking about Republicans or Democrats? Bc Republicans would be happy to welcome an overturn of Obergefell. Democrats did nothing about the court when Biden was president, and that was after it overturned Roe. Your statement is true in the abstract but divorced from current reality.

  1. Dems gave up because Manchin and Sinema insured there was no way forward and the old guard still ruled. Who knows what the landscape looks like in 2029 and the court's popularity is already at historic lows. Roberts, in his arrogance, still thinks the court is being pragmatic.
