I may not understand what you mean by "performative" but when someone stages a massive flag burning party I suspect they will give all of this a try in court.

What judicial or political philosophy will the Trumpist judges (e.g. Canon, Bove) hold to once Trump dies? I understand if there is no coherent philosophy, but what will be the driving interest once "please Trump" is moot?

The underlying complaint here - from rightists, that leftists use language they don't like - isn't about the language anymore, if it ever was. They were told leftists look down on them. They want leftists to be looked down on by their own people. The specifics don't matter.
