  1. Jesus fucking christ. The Trump administration tried to send a bunch of children to Guatemala at 3 am and justified it by saying that the kids just wanted to return to their parents in Guatemala, but the kids actually told the court that they are afraid of being sent back to Guatemala.

    Tweet from Joshua J. Friedman:

Plaintiffs: No. Possible some children might be in that situation, but everything we could find on short notice is children not in this situation.

Judge: Mr. Ensign you saying that *all* these children have parents who are requesting their return to Guatemala?

DOJ: That's what I've been toldTweet from Joshua J. Friedman:

Judge: During recess, I read provision you cited and then the complaint. Every one of 10 named plaintiffs says they are *afraid* of being sent back to Guatemala. (Reads aloud from declarations.) Doesn't line up with what govt is saying. This is why we have courts.

  2. NEW: In the dead of night, the Trump admin ripped vulnerable kids from their beds, attempting to return them to danger in Guatemala.

We’re heartened the Court prevented this injustice. We’ll keep fighting to protect our plaintiffs & all class members until the effort is enjoined permanently.

  3. The LGML case came very close to being JGG redux.

But just before the hearing began, the judge decided not to wait. She entered a TRO barring removal of all the children.

That made all the difference: DHS already had the kids loaded on planes. One plane even took off (then turned around).

This whole scenario feels like it's straight outta the government's Alien Enemies Act/J.G.G. playbook.

In J.G.G., Boasberg entered TRO barring removal of named plaintiffs and set weekend emergency hearing on certification of class. But DHS started removing people just before/during hearing...

  4. Judge Sooknanan: "These children are going to be deplaned. They're going to be returned to ORR custody. And no attempts will be made to remove them from ORR custody and remove them to Guatemala, in light of my order, while these preliminary emergency proceedings are pending."
