if this is the only thing they can hang on Jack Smith, then I would not be too worried if I were Jack Smith. Trump's minions violate the Hatch Act almost every day with no repercussions.

While it is not common, and certainly not applicable to Jack Smith’s tenure as Special Counsel, the Hatch Act can apply to former employees. It is rare, though, and usually invoked for egregious violations.

I agree that this is horseshit, but Jack Smith as special counsel IS a federal employee subject to the Hatch Act and the OSC is the proper agency to investigate violations of the Hatch Act. The Hatch Act has both civil and criminal provisions.
