Federal Reserve Board Governor Lisa D. Cook seeks an emergency temporary restraining order to prevent implementation of President Trump's August 25, 2025 Truth Social post
unlawfully purporting to remove her from her position as a Federal Reserve Board Governor. The
President's effort to terminate a Senate-confirmed Federal Reserve Board member is a broadside attack on the century-old independence of the Federal Reserve System. As one editorial described, it represents a blatant "grab for power in defiance of the nation's laws, and if it succeeds, it will be
to the detriment of the nation's interests."2
Governor Cook is likely to succeed on the merits of her claims that President Trump's
purported firing violated her statutory and constitutional rights. If the President's unlawful decree
were allowed to stand, the Board of Governors of the Federal Reserve System would be forced to
effectuate President Trump's unlawful attempted termination of Governor Cook, in violation of both the Federal Reserve Act (12 U.S.C. § 242) and the Due Process Clause of the Fifth Amendment. Governor Cook will succeed at showing irreparable harm, as President Trump's unprecedented actions threaten her Senate-confirmed position on the Board, and her ability to fulfill her duty to promote maximum employment and price stability. Finally, the equities and public interest both weigh in favor of keeping Governor Cook in her position, as her purported firing would jeopardize the independence of the Federal Reserve, and ultimately, the stability of
our nation's financial system.
