Breaking quorum is not a crime: When lawmakers leave the state to prevent a quorum (as Texas Democrats did in 2021 and again in 2025), they are not committing a criminal offense. This means they cannot be arrested.

We saw this same showdown in Wisconsin in 2010. The Democratic legislators eventually came back after a few weeks and Scott Walker gerrymandered us into oblivion for a very painful decade.
