  1. The Federal Employee Viewpoint Survey isn’t perfect, but it’s vital for tracking federal workplace conditions. Scrapping it now—when we need agency data most—is alarming. I am very worried about our ability to get accurate personnel data for the next 4 years.

  2. Yes, panels rotate, and a lot of it is luck of the draw. I don't know how many similar cases this panel will have, but it's conceivable there are others (also conceivable this is the end). But en banc review (i.e., review by the whole court) is there to ensure that panels don't go rogue.

  3. Judges Katsas and Rao are really on a rampage in the DC Circuit right now nixing lower court injunctions blocking impoundment and dismantling of agencies, all on justiciability, but the en banc court better listen to Judge Pillard, who has common sense on her side.

  4. This. For all the rhetoric about waste, fraud, and abuse, we sure seem to have a hard time recognizing it even when it's rolling down our streets in tanks.

    For the paltry sum of ~$31M, the federal government funds area studies National Resource Centers and Foreign Language & Area Studies fellowships for students nationwide. We're probably wasting wildly more than this Doing A Fascism in the national capital right now. It's shameful & maddening.

  5. I can see that, but who is the audience? Who needs to be told? Are they going to get the message from the discourse on Bluesky? This is something that I struggle with a lot--people do not have the information they need to make good decisions in our democracy. Not sure social media is the answer.

  6. With respect, your framing illustrates precisely what I'm talking about. I'm not talking about a positive vision that "might come out of the current regime," but instead something outside of it. And if your answer is, well, Trump has already won, what are we even doing.
