The fucking protein powder has a shrink wrap arbitration agreement now? This is like a nightmare law school hypo

lol creative

If someone gives it to you as a gift there’s no consideration so you could likely sue them regardless of the words because there’s no contract.
-
Cut open the side, become ungovernable
-
"If you do not agree to be bound" feels like the title of a book about the era we're living in
-
😂
-
zero change i would ever use that powder because i guarantee there's a mountain of lead in there
-
DRM creep is wild
-
what if you have your kid open it
-
American consumer laws are a JOKE. Like most of the country
-
Entire appellate body of law around the fact that these terms are only disclosed once you break the package seal and open the lid, rendering a return impossible
-
Going to need to agree to all cookies before digging into my Ben and Jerry’s soon
-
What if my small, illiterate child opens the container, breaks the seal, and discards the broken seal with the text on it, then I use the product? Am I still beholden to the blood pact?
-
Shotgun that powder bite thru the side
-
This seems like the company that also would not keep up on their domain payments or just 404 the terms and conditions page and go 🤷
-
All packaging should say “by opening this you agree to not complain if there is no product inside”
-
You will agree to be bound!
-
So, did you break the seal? 👀
-
Damn, every time I think I’m used to the dystopia it surprises me. Honestly kinda impressive.
Next will be little notches in the measuring spoon with “accept”, “acknowledge” or “agree” depending on how much you scoop.
-
De facto proof that this company shouldn't be trusted, and nobody should buy their products
-
So what happens if my 10 year old opens it? Does that mean she legally agreed to it?
-
Nuts
-
So, if you let someone else open it, the opening clause is not satisfied, right?
-
lol, I admire the cross-team collaboration required to do this cleverly.
-
Getting put in jail because I drilled a hole in the bottom of the can to avoid setting off the EULA alarm that gets sent to the protein powder authentication server when it gets opened. It's like pirating protein powder.
-
That’s crazy.
-
By opening this powder you forfeit your rights and destroy the evidence that we had you do this.
-
i hate it here
-
When The Man adds that warning to my Chef Boyardee Beefaroni I riot!!!
-
Shut it down. We've failed as a society.
-
I opened the can with a can opener, your honor. I never acknowledged the agreement.
-
Wait until Charmin and Angel Soft start printing this on the role.
-
I'm sure this is unenforceable in a number of jurisdictions, but IANAL.
-
nothing says "This product sure is safe to consume" like the packaging screaming YOU CAN'T SUE US YOU CANT SUE US YOU CANT SUE US YOU CANT SUE US! As you open it.
-
If it needs T&C, you might wanna pass on that.
-
Don't mind me, just crossing stuff out and initialling it before I open my food...
-
It's like when you are on step 40 of putting together some flat-pack furniture and realize that you did something very, very wrong many steps ago only for society.
-
that is amazing
-
just cut open the package from the bottom
-
buy one and return one on every trip to the store
-
😲😲😲
-
What are they hedging against? Misrepresenting # of grams of protein? Muscle-building fraud? Sliced fingers on pull back tab? Mold? Caveating verbiage on this product is super confusing
-
Put the contents in an envelope and post it back to them 😂
-
Why are you putting that industrial waste in your body?
-
😳
-
I put this in my coffee every morning and never noticed
-
10% of your muscle mass belongs to creacorp
-
Here I was all this time just thinking how nice it was they moved towards more environmentally friendly packaging. Never noticed that fine print. 😅
-
this is what they should be teaching in contracts imo
-
Would be interesting to see if you could get a full expenses refund for this.
-
They've been doing this for a few years apparently, we got this on March of 2023. But you can opt out in case you feel like... writing a letter to a protein powder company.
Which my wife did.
-
What product is that? I’d buy a ton of them, partially open them to reveal the “agreement” and then return it for non-acceptance where I’d demand a refund per the terms on the label.
-
Really wondering what lead to them having to print that on the seal...
-
-
jesus christ
-
So, if you open this and there happens to be a human hand packed in wheat flour inside, you can't sue?
-
Meanwhile,
FDA warns public not to eat possibly radioactive shrimp sold at Walmart
The FDA is warning the public not to eat, sell or serve certain Great Value raw frozen shrimp sold at Walmart due to possible contamination with Cesium-137.
-
Protein powder has a EULA? ⚖️🤔🤣
-
This is such a hostile design. No way it holds up in court.
Then again, Disney pulled this shit with someone who had turned on Disney+ once when they tried to sue the park, so…
-
Yeah it’s gonna be a nightmare for these sleeves once I’m popping out of them
-
Opened one of these 2 days ago and didn't even think to read it, wrongfully assuming it was the usual don't use if the seal is broken warning. Ridiculous something like this is legal
-
I'd return it through the front window of their headquarters
-
Wow. That’s the last time I would ever buy that product.
-
what if you cut a hole in the side and pour the powder into another container?
-
They wouldn’t be binding you to arbitration if they didn’t think there was a greater than 0% chance their shitty powder was contaminated with melamine.
-
“By opening and using this product…” but opening by WHICH METHOD, sir! Is it stipulated? Then I’ll see you in court.
-
at least you dont need to download an app to use it
or update its firmware
-
It's not on a seam you need to break, but I've seen similar wording on GMO'd grapes/chillis before about not using their patented seeds.
-
"Should you be so bold, dear Customer, as to break this Seal, be fairly warned and advised that What comes of it shall be upon your own Head..."
-
Open the bottom with a can opener instead.
-
Im not a law talking guy but that doesn't seem like it would hold up if challenged.
-
-
🇺🇸🇺🇸🇺🇸🇺🇸
-
You can have gains or rights, but not both.
-
Have a child open it for you then dare ' em to try to enforce that contract.
-
Open it from the bottom.
-
-
That seems very much not legally binding, but I would definitely never buy from that company again.
-
Does anyone read these?
-
The same vital proteins that had their collagen peptides recalled a few years back?
Sketchy af.
-
Thinking seriously about sealing myself in a similar container. You wanna talk to me, it's going to come with serious legal strings attached, don't say you weren't warned.

America has far more lawyers than engineers.
China has far more engineers than lawyers.
Guess which economy will prevail, as the years go by?
